Safeguarding your privacy is important to us. Therefore, in this privacy statement we describe what information we collect from you and how we use that information.

This privacy statement covers the data collection we do through our website.  For other data processing, a specific privacy statement may apply.  By submitting your data on our website, you confirm that you have read and understand this privacy statement and the terms we have included in it.

1. Who are we?

BePowered, with registered office at Beekhoek 34, 2440 Geel (hereinafter BePowered, “we” or “us”), is the data controller of your personal data that are collected via the website.

2. What personal data do we collect?

BePowered collects, registers and processes personal data of users of its website via the contact form.   Thus BePowered collects, records and processes the following data from you when you fill out the contact form on our website:

  • Name;
  • First name;
  • Telephone number
  • E-mail address;
  • Name of company or organisation

On our website we also use cookies or similar technologies, mainly to optimize our website for users.  These cookies may also collect personal data from you in some cases. For more specific information about the cookies we use you can consult our cookie statement.

 

3. How do we use your data?

The personal data listed above are required to be provided when filling out the contact form.  Without this personal data we cannot answer your request.  The processing of your personal data is therefore entirely related to answering your request.  By filling out the contact form you give us permission to process your data for this purpose.

We will not use your personal data for any other purpose.

If you have given us your permission to do so, we may also use the e-mail address you provided to send you e-mails relating to our activities, promotions and actions.  When you receive these e-mail messages, you always have the option to change your preferences or to unsubscribe.  You can also unsubscribe at any time by sending an e-mail to the following e-mail address hello@bepowered.be. 

 

4. With whom do we share your data?

BePowered may share your personal data with external service providers that it uses to provide its services to you.  Such service providers only act as processors on behalf of BePowered and BePowered will enter into the necessary processing agreements with these service providers. 

Furthermore, we will not pass on personal data to third parties unless we are obliged to do so on the basis of mandatory legal provisions (e.g. passing on to external bodies, such as supervisory or law enforcement agencies) and/or as a result of a court order or a government order.

In any case, we will ensure that all reasonable security measures are taken to make the transfer of your data secure. 

For the sake of completeness, we note that in some places our website redirects to the websites of third parties (e.g. suppliers of brands that we have in our import portfolio).  No personal data is shared during this redirection, but it is possible that the third-party website to which redirection is made also collects and processes personal data from you.  BePowered is not responsible for the content of these websites and/or how these websites process your personal data.  For more information about this we refer to the privacy and cookie statement of the respective websites. 

 

5. Will your data be transferred abroad?

In principle, your personal data will not be transferred abroad.   

To the extent that such transfers would nevertheless be necessary, we take the necessary steps to ensure that your personal data is protected to a high degree and that all transfers of personal data outside of the EEA are lawful.

If a transfer is made to a country outside the EEA for which the European Commission has not determined that the country provides an adequate level of protection, this transfer is always subject to an agreement that meets all the requirements for transfers to third countries, such as the approved standard provisions on data protection adopted by the European Commission. 6. How long will your personal data be kept?

We do not keep your personal data longer than necessary for the fulfilment of the intended purpose for which your personal data is collected.  This means that we will in principle delete your personal data as soon as the request for which you have forwarded your personal data to us has been fulfilled (e.g. job application data is kept until the job vacancy has been filled in).

If you have given us permission to use your data for marketing purposes, we will retain your data for up to 5 years after giving such permission (unless the permission is withdrawn in the meantime).

Notwithstanding the foregoing, we will not be able to delete certain personal data if there is a legal obligation to retain it, or if we may need it in the context of legal proceedings.

 

7. How is your personal data secured?

We have taken all reasonable and appropriate technical and organizational security measures to protect your personal data as much as possible against accidental or intentional (and unauthorized) manipulation, alteration, disclosure, loss, misuse, destruction or access by unauthorized persons.

 

8. Your rights with regard to your data

Under the terms of the General Data Protection Regulation you have the right to (insofar as the specific conditions for the application of such a right are fulfilled)

  • Access to and information about the personal data we process about you;
  • Oblivion or to ask us to erase your personal data;
  • Rectification and supplementation;
  • Transferability of personal data;
  • Restriction of processing;
  • Objection.

To verify your identity, we ask you to send a copy of the front of your identity card with each request. After verifying your identity, BePowered will destroy the copy in question.  BePowered will respond to your request as soon as possible, but in any case within four weeks.

You can exercise all these rights free of charge, unless your request is manifestly unfounded or excessive (e.g. because of its repetitive nature). In that case, we have the right to charge you a reasonable fee or refuse to act on your request.

 

9. Do you have a complaint?

If you have a complaint about the way we process your personal data, you can always notify us at hello@bepowered.be so that we can respond to it.
